Welcome to OrchidStonePark ("we," "our," or "us"). These Terms & Conditions ("Terms") apply to your interaction with our luxury yacht charter services and our website at orchidstonepark.site (the "Service"), managed by OrchidStonePark.
By securing a charter or using our Service, you consent to adhere to these Terms. Should you object to any section of these terms, you are prohibited from utilizing the Service.
2. Service Overview
OrchidStonePark offers an array of high-end yacht charter services which include:
- Day-long yacht hire
- Evening boat tours
- Company getaways
- Exclusive gatherings
- Extended yacht voyages
Services are subject to availability and climatic conditions. We reserve the option to alter or cease services without prior notice.
3. Booking and Reservations
3.1 Booking Process
To reserve a yacht, you must:
- Be no younger than 18 years
- Submit valid and comprehensive details
- Make the required initial payment as outlined in your booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Your reservation becomes official upon payment receipt and our formal acknowledgment. We have the authority to deny service at our sole discretion.
3.3 Availability
All yacht charters depend on the availability of the vessel and favorable weather conditions. We strive to meet your requested dates and times to the best of our ability.
4. Payment Terms
4.1 Pricing
All costs are presented in € and are inclusive of applicable taxes unless stated otherwise. Prices are subject to modification without prior notification.
4.2 Payment Schedule
- Deposit: 50% of the cumulative charter fee, payable at the time of reservation
- Final Payment: Due 48 hours ahead of the charter's commencement
- Incidental expenses (if applicable): Payable at the charter's end
4.3 Payment Methods
We welcome payments via major credit cards, wire transfers, and certified bank drafts. Transactions are processed using secure, encrypted channels.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- Cancellations more than 72 hours prior to departure: Full reimbursement minus transaction costs
- Cancellations made between 24 to 72 hours before departure: 50% refund
- Cancellations less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
If the captain determines weather conditions as unsafe, we will suggest:
- Rescheduling the charter for the next suitable date without extra charges
- A complete refund if rescheduling is impractical
5.3 Mechanical Issues
In the event of mechanical issues with your designated yacht, we will try to offer an appropriate replacement. If an alternative is unavailable, a complete reimbursement will be granted.
6. Safety and Conduct
6.1 Safety Requirements
All guests must:
- Heed all instructions from the crew
- Utilize the provided safety gear as needed
- Notify of any health conditions that may impact their safety
- Stay within authorized areas aboard the vessel
6.2 Prohibited Items
The following articles are not to be brought onboard:
- Glassware
- Banned substances
- Weapons or dangerous items
- Excessive quantities of beverages (beyond what's deemd moderate consumption)
- Animals (unless pre-authorized)
6.3 Conduct
Passengers are expected to behave in a respectful and considerate manner. Should passenger behavior threaten safety or disturb other guests, we reserve the right to terminate the charter prematurely with no refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount paid for the yacht charter. We are not accountable for:
- Injuries owing to passenger negligence
- Theft or damages to personal property
- Secondary, consequential, or punitive damages
- Delays due to weather or events beyond our oversight
7.2 Insurance Coverage
Comprehensive maritime insurance is maintained on our fleet and operational activities. It is the responsibility of guests to secure their own travel and personal possession insurance.
7.3 Assumption of Risk
By engaging in our services, you recognize that water-based activities carry inherent risks and you accept accountability for your safety and welfare.
8. Modifications and Itinerary Changes
We hold the right to adjust itineraries, courses, or timetables due to climatic constraints, safety necessities, or operational needs. We will endeavour to offer equivalent options whenever possible.
9. Force Majeure
Delays, cancelations, or alterations caused by situations outside our control, which may include, but are not limited to:
- Extreme weather scenarios
- Natural catastrophes
- Regulatory injunctions
- Port shutdowns
- Technical breakdowns
10. Privacy and Data Protection
Your personal data is managed in line with our Privacy Policy. Utilizing our services indicates your assent to the collection and use of your data as detailed in our Privacy Policy.
11. Intellectual Property
All materials on our website, encompassing text, visuals, trademarks, and photos, are safeguarded by copyright and other intellectual property laws. Unauthorized reproduction, circulation, or creation of derivative works is prohibited without express permission.
